New Order on Alcoholic Beverage Sales for Restaurants Amid the Pandemic

Gov. Tom Wolf announced today a new order for restaurants as they prepare to increase indoor occupancy to 50 percent on September 21st. According to a press release on the governor's website, the order declares that the sale of alcohol in establishments "must end at 11:00 PM starting on Monday, September 21 and all alcoholic beverages must be removed from patrons by midnight." Wolf says the order also applies to those establishments that choose to stay at 25 percent occupancy.

Last week, the governor said restaurants will be able to "self-certify" their compliance with regulations from the Centers for Disease Control and Prevention in order increase their occupancy. Wolf said the self-certification "ensures that restaurants can expand indoor operations and commit to all appropriate orders so that employees and customers alike can be confident they are properly protected.” According to the press release, those restaurants will appear in an online database which will be available to people across the state.


The governor released guidelines for restaurants to self-certify on September 8th, which include the following:

  • A list of requirements contained in the current restaurant industry guidance and enforcement efforts;

  • A statement that the owner has reviewed and agrees to follow these requirements;

  • The business’ maximum indoor occupancy number based on the fire code; and

  • A statement that the owner understands that the certification is subject to penalties for unsworn falsification to authorities.

Establishments looking to increase their capacity must complete the self-certification form by October 5th. Wolf says documents and additional information on the process will be available online September 21st.
